• Le tutele giuridiche sull'hardware/software è improntanta a proteggerne la proprietà. Non soltanto intesa come disponibilità del bene, ma anche e soprattutto come proprietà intellettuale, cioè quelle norme che si occupano di tutelare I frutti dell'inventiva e dell'ingegno umano.
• Mentre l'hardware viene tutelato attraverso lo strumento del brevetto (proprietà industriale), il software è ricondotto a quella del diritto d'autore (copyright) non senza molteplici discussioni. In realtà nel corso degli anni, si è ammesso che anche il software può essere brevettato, qualora esso abbia un effetto tecnico
• Specialmente rispetto al software, l'accostamento a questi istituti ha fatto discture, ragioni di tutela economica più che giuridica
• Esistono tuttavia modelli diversi che si rifanno a principi libertari e di accesso alla conoscenza, sopratutto per il software (open source)
• Recentemente si è espansa la tutela dell'hardware e del software (informazione su processo industriale) tramite il segreto industriale

Il brevetto

• Diritto a produrre e commercializzare in esclusiva un oggetto o sistema sul territorio in cui viene concesso
• Strumento giuridico di tutela che conferisce a chi ha realizzato un'invenzione il monopolio temporaneo di sfruttamento
• Diritto di vietare a terzi di produrlo, usarlo, metterlo in commercio, venderlo o importarlo e trarne profitto
• In Italia: Codice della proprietà industriale, emanato con il D.L 10 febbraio 2005

La brevettabilità del software

• Esigenze economiche e produttive anche di tutela tramite brevetto
• Proposta una direttiva per la brevettabilità del software, bocciata nel luglio 2005 (648 contro e solo 14 i favorevoli, con 18 astenuti)
• Ruolo della giurisprudenza che valorizza l'espressione "in quanto tale": si accede anche al brevetto, sempre che sussista un effetto tecnico, un idea è espressa anche in modo logico o algoritmico. Sono le cosiddette "computer-implemented invetions"

Computer-implemented inventions: esempi

• un software che controlla il sistema frenante di un'automobile oppure un processo industriale od un sistema di comunicazione a distanza.
• un'applicazione che consenta di controllare dal telefono l'allarme della propria abitazione, il sistema di riscaldamento, l'impianto audio etc.
• un'applicazione software che riduca la distorsione od il rumore di fondo di una registrazione audio, un traduttore automatico oppure un software che permetta il funzionamento di un navigatore GPS.
• Un software che fa funzionare il touch screen di un telefono cellulare o quello che gestisce i consumi energetici di un'autovettura.
• Programmi che gestiscono il funzionamento interno di un hardware, ad esempio permettendo una migliore organizzazione della memoria del computer.
